1. Acceptance
By accessing or using the services provided by The Payments House LLC Ltd. ("The Payments House LLC", "we", "our"), you agree to be bound by these Terms of Service together with the Merchant Services Agreement executed at onboarding.
2. Eligibility
Our services are offered to legally constituted businesses that have passed our underwriting and KYC/KYB process. Individuals acting in a personal capacity are not eligible.
3. Services
The Payments House LLC provides payment gateway, acquiring, settlement, FX, payout and related risk-management services. Specific service scope and pricing are documented in your Merchant Services Agreement.
4. Reserves & holdbacks
We may establish rolling, fixed or capped reserves at our reasonable discretion to mitigate chargeback, refund or insolvency exposure. Reserve terms are disclosed in your MSA.
5. Prohibited activities
You may not use The Payments House LLC for any activity listed in our Acceptable Use Policy or that is unlawful in any jurisdiction where you or your customers are located.
6. Termination
Either party may terminate the relationship in accordance with the notice provisions of the MSA. We may suspend services immediately for material breach, fraud, or regulatory order.
7. Limitation of liability
To the maximum extent permitted by law, The Payments House LLC's aggregate liability is limited to the fees paid by you in the three months preceding the event giving rise to the claim.
8. Governing law
These terms are governed by the laws of the Federation of Saint Kitts and Nevis, with exclusive jurisdiction in the courts of Charlestown, Nevis, unless your MSA specifies otherwise.
